New Eat out at Cubbon Park ?: Bangalore

The Cubbon Park is in the news again. Not long ago, the construction of an underground car parking complex at an estimated cost of Rs 33 crore had generated heat with a section of advocates opposing it. Now, the state government has filed an interlocutory application seeking permission to construct temporary canteen/outlets for the use of advocates, staff and litigants in a corner space between the High Court and the KGID building. Again, some people have been opposing it saying the construction is against the observations made by the apex court in the matter related to Cubbon Park. Explaining the need for a canteen, the government said, “Two canteens/outlets were existing towards the north of the high court premises. The construction of temporary canteen/outlets for the use of advocates, staff and litigants here in the proposed place in Cubbon Park is absolutely necessary and the construction will be temporary and it will not involve any cutting of trees and it would not seriously alter the Cubbon Park.’’ In 1998, a PIL challenged the government notification of July 30, 1998 under sub-sections (1) and (2) and section 3 of the Karnataka Government Parks (preservation) Act, 1975 contending that the boundaries of the Cubbon Park have been altered. The high court then passed an interim order directing the state government not to alter the park without its prior permission. Now, the public works department, having received the request for a canteen from the Registrar General on June 13, 2008, has moved the court before taking up the work.
